These Terms and Conditions set out the basis on which Rubbish Removal Knightsbridge provides rubbish removal, waste collection and related services to domestic and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, company or organisation that requests or uses our services.
Services means rubbish removal, waste collection, waste clearance, bulky item removal and any ancillary services we agree to provide.
Waste means the rubbish, items, materials or goods that the Customer asks us to remove, collect or dispose of.
Agreement means the contract between the Customer and Rubbish Removal Knightsbridge formed in accordance with these Terms and Conditions.
2. Scope of Services
Rubbish Removal Knightsbridge provides waste clearance and rubbish removal services for domestic households, landlords, property managers and commercial clients. Services may include the collection, loading, transportation and lawful disposal or recycling of waste, as agreed at the time of booking.
We will provide services with reasonable skill and care and in accordance with applicable UK law and waste regulations. However, we do not guarantee that all items presented as waste can be collected, and we reserve the right to refuse items that we are not legally permitted or practically able to carry.
3. Booking Process
3.1 Bookings can be made by telephone, email or via any booking system we make available. The Customer is responsible for providing accurate information regarding the property access, type and estimated volume or weight of waste, and any special conditions or restrictions that may affect the service.
3.2 Any quote provided before our arrival is based on the information the Customer supplies. All bookings, including indicative quotes, are subject to confirmation upon inspection of the waste and job conditions by our team on arrival.
3.3 The Agreement between the Customer and Rubbish Removal Knightsbridge is formed when the Customer accepts our quote and we confirm the booking, either in writing or verbally, and a time slot is allocated.
3.4 Time slots are estimates only. We will make reasonable efforts to arrive within the agreed time frame but external factors such as traffic, access issues or unforeseen delays may affect our arrival time. We shall not be liable for minor delays that do not materially affect the performance of the Services.
4. Estimates, Quotes and Pricing
4.1 Prices are generally based on the volume of waste, weight, type of material, ease of access, labour required and disposal costs. Where possible, we will provide an estimate in advance based on the Customer's description, subject to confirmation on site.
4.2 The final price will be confirmed before any work starts, once our team has inspected the waste and assessed the job. If the actual load, access, location or type of materials differs from the Customer's description, the price may be adjusted.
4.3 If the Customer chooses not to proceed after the final price is confirmed on site, we reserve the right to charge a call-out or attendance fee to cover our time, travel and administration costs.
4.4 All prices are quoted in pounds sterling and may be inclusive or exclusive of VAT, depending on our current VAT status. Where VAT applies, this will be clearly identified on invoices or receipts.
5. Payments
5.1 Payment is due in full on completion of the Services, unless otherwise agreed in writing in advance. We may require a deposit or full pre-payment for certain jobs or for commercial accounts.
5.2 We accept payment by cash, bank transfer, card or other methods notified to the Customer at the time of booking. Cheques are not normally accepted unless we agree in advance.
5.3 For approved commercial accounts, payment terms will be specified in the account agreement. If no specific terms are agreed, invoices must be paid within 14 days of the invoice date.
5.4 If payment is not received by the due date, we reserve the right to charge interest on overdue amounts at the statutory rate, together with reasonable costs of debt recovery, including legal fees where applicable.
6. Customer Obligations
6.1 The Customer must ensure that we have safe, reasonable and timely access to the property, premises and waste on the agreed service date. This includes arranging any necessary parking, access codes, gate permissions, building entry or lift use.
6.2 The Customer must ensure that any waste requiring removal is clearly identified and separated from items that are not to be taken. We are not responsible for removing items that are not clearly presented as waste, nor for leaving behind items that the Customer has not reasonably identified.
6.3 The Customer confirms that they own the waste or have the full authority of the owner to arrange its removal. The Customer remains responsible for any claims relating to lack of authority to dispose of the waste.
6.4 The Customer must inform us in advance of any hazardous, sharp, heavy, awkward or potentially dangerous items so that we can assess if it is safe and lawful to remove them.
7. Waste Types and Exclusions
7.1 We operate in accordance with UK waste regulations and hold or use appropriate waste carrier registration as required by law. We will only collect waste types that we are authorised and equipped to handle.
7.2 Certain items will not be collected, including but not limited to: asbestos or materials suspected to contain asbestos, clinical or medical waste, chemicals, solvents, oils, gas bottles, pressurised containers, explosives, and any substance classified as hazardous that we are not licensed to carry.
7.3 We reserve the right to refuse any waste which we consider unsafe, illegal, excessively heavy, contaminated, or unsuitable for collection or transportation.
7.4 If prohibited items are discovered within the load after removal, the Customer may be responsible for any additional costs, fines, or treatment charges incurred as a result, together with any penalties arising from breach of waste regulations.
8. Cancellations and Amendments
8.1 The Customer may cancel or amend a booking by giving us reasonable notice by telephone or email. For standard residential bookings, we ask for at least 24 hours notice prior to the arranged time slot.
8.2 If the Customer cancels with less than 24 hours notice, or fails to provide access at the agreed time, we reserve the right to charge a cancellation or missed appointment fee to cover our reasonable costs.
8.3 For large, specialised or commercial jobs where we have committed additional resources or incurred specific costs, different cancellation terms may apply. These will be advised at the time of booking and will form part of the Agreement.
8.4 We may cancel or reschedule the Services if events beyond our reasonable control occur, such as severe weather, vehicle breakdown, accidents, illness, or where we believe it would be unsafe or unlawful to perform the work. In such cases, we will seek to agree an alternative date and time with the Customer.
9. Service Performance and Limitations
9.1 We will use reasonable care to avoid damage to property and premises while carrying out rubbish removal and waste collection. However, the Customer is responsible for protecting floors, walls, driveways and other surfaces where necessary. Heavy loads, trolleys and lifting may cause marks or damage on certain surfaces.
9.2 Our personnel are not authorised to carry out structural alterations, dismantle permanently fixed items, or disconnect gas, electrical or plumbing connections. Any assistance of this nature provided at the Customer's request is entirely at the Customer's risk.
9.3 Where access is restricted or difficult, we may require the Customer to move items or provide additional assistance, or we may need to adjust the price to reflect additional labour or equipment required.
9.4 We do not provide deep cleaning, decontamination or pest control services as part of standard rubbish removal. These services, if offered, will be subject to separate terms.
10. Title, Responsibility and Disposal
10.1 Once our team has loaded waste onto our vehicle and payment is made or agreed, title to the waste passes to us and we become responsible for its lawful transportation and disposal.
10.2 We will dispose of or recycle waste at licensed facilities, in accordance with UK waste management legislation and duty of care requirements. We may sort, separate, reuse, recycle or resell items where lawful and appropriate.
10.3 Where we leave waste on site at the Customer's request, or where the Customer has not completed payment, title and responsibility for that waste remains with the Customer.
11. Liability and Limitations
11.1 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which it would be unlawful to limit or exclude liability.
11.2 Subject to the above, our total liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for the specific job in question.
11.3 We shall not be liable for any indirect, consequential or purely economic losses, including loss of profit, loss of business, or loss of opportunity, arising from or in connection with the Services.
11.4 The Customer must notify us of any apparent damage to property or issues with the Services as soon as reasonably possible and in any event within 48 hours of completion. We may require reasonable evidence and an opportunity to inspect any alleged damage.
11.5 We are not liable for any loss or damage resulting from inaccurate information supplied by the Customer, lack of proper authority to dispose of waste, or failure by the Customer to comply with these Terms and Conditions.
12. Insurance
We maintain insurance appropriate for a rubbish removal and waste collection business, including public liability cover up to a reasonable level. Insurance details are available on request. This insurance is subject to its own terms, conditions and exclusions, and does not replace the need for the Customer to maintain their own property and contents insurance.
13. Complaints and Disputes
13.1 If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible with details of the issue. We will investigate and seek to resolve complaints promptly and fairly.
13.2 Where a dispute cannot be resolved directly, both parties agree to attempt to settle the matter through negotiation in good faith before considering formal legal proceedings.
14. Data Protection and Privacy
14.1 We will collect and process personal data such as names, contact details, addresses and payment information for the purpose of providing and administering the Services, managing bookings, and handling accounts and enquiries.
14.2 Personal data will be handled in accordance with applicable UK data protection laws. We will take reasonable steps to keep Customer information secure and will not sell personal data to third parties.
14.3 We may share necessary information with trusted third parties such as payment processors, insurers or regulatory authorities where required to provide the Services or comply with legal obligations.
15. Changes to these Terms and Conditions
15.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time the Customer makes a booking will apply to that specific Agreement.
15.2 Any material changes to these Terms and Conditions may be communicated on request or via our standard communication channels.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any Agreement formed under them, are governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to hear and determine any dispute, claim or proceedings arising out of or in connection with the Services or these Terms and Conditions.
17. General Provisions
17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid, and the remaining provisions shall continue in full force and effect.
17.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.
17.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary to provide the Services.
17.4 These Terms and Conditions, together with any specific details confirmed at the time of booking, form the entire agreement between the Customer and Rubbish Removal Knightsbridge in relation to the Services and supersede any previous understandings or representations, whether written or oral.
